What clauses should a Will usually contain in order to be complete ?

To be complete, a Will usually contains the following clauses:

  • Revocation of the previous Will;
  • Marital status and matrimonial regime;
  • Funeral arrangements;
  • Legacies by particular title (specific bequests);
  • Universal legatees;
  • Age for the remittance of shares to legatees;
  • Protection of legatee against creditors: exempt from seizure clause;
  • Protection of legatee against spouse: private property clause;
  • Appointment of the estate liquidator;
  • Powers and duties of the liquidator;
  • Appointment of a guardian for minor children.

Depending on your wishes and desires, or your personal situation, some of these clauses may not apply, such as the legacies by particular title, or the appointment of a guardian if you have no minor children.
