A parental union is formed when two de facto spouses become the parents of the same child after June 29, 2025. The same applies when the father and mother or the parents of the same child become de facto spouses or become de facto spouses again.
Transitional provisions : Persons who, on June 29, 2025, are already the parents of the same child and meet the other conditions to be considered de facto spouses in a parental union may, by mutual agreement, choose to be subject to this regime. To do so, they must formalize their commitment either by a notarial deed en minute, or by a private deed signed in the presence of two witnesses.
