In Quebec, the creditor who intends to exercise a hypothecary right against a debtor in default under a movable hypothec, must file with the RDPRM a prior notice, accompanied by the proof of notification which he made to the debtor as well as to any other person against whom he intends to exercise its right.
Following the registration of this prior notice, the debtor has twenty days to remedy the default before the creditor can exercise its hypothecary right.
