What is a formal notice?

The formal notice, also called demand letter, is used to formally instruct its recipient to perform an obligation to which he or she committed, within a specified time limit that should be reasonable enough to allow the recipient to respond. Indeed, to require the performance of an obligation or the payment of a sum of money, a simple verbal notice is often insufficient. The formal notice is a formal letter in which you explain to any person, firm trader what is exactly alleged against the latter and by which you claim what the latter legally owes to you, since your claim must be based on the existence of a legal right in your favour.

You can write the formal notice yourself, date it, sign it and send it. However, it is advisable to be honest and accurate, as its contents could be used against you, should a legal action be eventually brought before the Court. Making threats prohibited by law or inventing facts that never occurred in the formal notice must be avoided at all costs.
