What happens if a legal action was not preceded by a formal notice?

A legal action that would have not been preceded by a formal notice automatically entitles the person who is being sued to a reasonable time period to fulfill his or her obligations from the date of filing of the legal action. Thus, this party could remedy the situation, which will put an end to the action. This is what is commonly called an out-of-court settlement. On the other hand, all legal fees incurred and paid will not be refunded to the person who paid them.
