As of June 30, 2025, a parental union is formed when de facto spouses become the father and mother or parents of the same child. The same applies when the father and mother or parents of the same child become de facto spouses or become de facto spouses again.
When one of the spouses is married, in a civil union or in a parental union, a parental union with a new spouse is formed only upon dissolution of the marriage or civil union or, as the case may be, upon termination of the parental union.
A parental union may not be formed by persons who are, in relation to each other, an ascendant, descendant, brother or sister.
De facto spouses are two people who live together and publicly present themselves as a couple, regardless of the length of time they have lived together. Cohabiting persons who are the father and mother or parents of the same child are presumed to be living together.
Parental union is terminated by the death of one of the spouses, by cessation of cohabitation or by the marriage or civil union of both spouses, or by the marriage or civil union of one of them with a third party.
