Superficies results from a division of the immovable property between the land and the constructions erected thereupon in two separate lots. There is henceforth two superimposed rights of ownership: one attached to the land, that we call the subsoil, and the other attached to the constructions, that we call superficies. Superficies can also consist of a new construction built over an existing construction.
